The Plantation at Placencia - Protective Covenant

1. Residential Use: All residential lots as delineated in Master Plan, and Improvement located thereon, shall be used, improved and devoted exclusively for single family use. Nothing shall be deemed to prevent the owner from leasing the lot and improvements subject to the other provisions of these covenants.

2. Restriction on further Subdivision: No residential lot or portion of a lot in this master Plan Community shall be divided or sold or resold, or ownership changed or transferred whereby the ownership of any portion of this subdivision shall be less than correction, deeds to resolve boundary dispute and similar corrective instruments. Lots may be joined and lots may be subsequently divided into the lots originally joined.

3. Setbacks. No building shall be erected on any single family lot which is less than Twenty (20) feet from any frontline; not less than ten(10) feet from any side yard lot lines; and not less than fifteen (15) feet from said rear lot line

4. Building Plans. All building plans must be approved in writing by the developer prior to the construction of any building, walls, fence or docks. Yard walls and fences shall not exceed (5) feet in height.

5. Height Lot Coverage. No residential building shall exceed two (2) stories in height and in no cases shall the ground floor area of the house, garage and any buildings cover more than thirty-five percent (35%) of the lot area.

6. Sewage Disposal. Septic disposal system shall be of a non-pollute design and operation and shall be subject to inspection and approval by the developer before use. NO occupancy building can occur until such inspection by the developer has taken place and approval has been received in writing. Once a public sewage distribution system is installed no further septic system shall be permitted.

7. Signage. No signage shall be allowed at anytime on a residential lot of purpose of advertising or notice with the exception of the sign advertising the lot or the home for sale. Such signs shall not exceed two (2) feet by three (3) feet in size.

8. Homeowner Association. The plantation at Placencia shall establish it's own Homeowner's Association for the purpose of maintenance of roads, community parks, nature and eco-preserves, buffer zones, canals and drainages.

9. Lot Maintenance. All lot shall be maintained free of debris, junk, unused construction materials, toxic waste, or litter of any kind. At no time shall on-site burial of such materials be permitted.

10. Temporary Structures. Mo temporary structure of any nature, including, but not limited to, tents, campers, mobile homes, shacks, etc., shall be used either as a permanent or temporary dwelling unit. During home construction, a construction trailer or camper may occupy the lot for a period not exceed eight (8) months and with a developer approved sewage system.
11. Parking. Each resident shall provide parking for no less than one (1) vehicle. No vehicle shall be kept on any right-of-away. Vehicle repair shll not be constructed on right-of-away.

12. Animals. Only domestic Animals shall be allowed on the property and shall be contained on the owners lot or on a leash. Cows, horse, pigs, sheep, goats and fowl shall not be consider domestic pets.

13. Satellite Dishes. All satellite dishes; tower or other receiving antennas must be located in rear of the dwelling. Similarly, all laundry lines must be located at rear or side of the dwelling and out of the public view.

14. Tree Cutting. No cutting of any trees is permitted by any lot owner in any area set aside for park, nature or eco-preserve, public reserve or buffer zone, unless otherwise determined to be a hazardous condition which would threaten public safety, such determination to be made by the developer or home owner association.

15. Drainage. Lot owner/homeowners shal not permit waste to be drained on to the road right-of-away or adjacent property. Lot owners shall not restrict the disharge of storm water flowing off the roads through discharge drains or swales.

16. Firearms. There shall be no hunting or discarging firearms within the limit and boundaries of the Plantation at Placencia.

17. Docks. All dock construction must be approved by the developer before the construction commences. Should the government of Belize require permit or special license for docks, this shall be at the property owners expenses. Boat size, height and beam allowed into the canals will be limited. Zero wake rules be enforced within the canal, marina, and lagoon area adjacent to The Plantation at Placencia.

18. Masterplan. The developer has obtained approval for a master land use and zoning plan from the government of Belize. Strict adherence to these plans and their provision will be monitored by the architectural control committee. Initially, such architectural Control Committee shall consist solely of the developer’s representatives.
